ANATEL refers to the Brazilian Telecommunications Agency, which is the abbreviation of Agência Nacional de Telecomunicações in Portuguese. The Brazilian Telecom Agency is established in accordance with the Brazilian "Telecommunications Law" and is the official agency for the regulation of telecommunications in Brazil. According to the requirements of Brazil's "Telecommunications Product Certification Standards", ANATEL is in charge of the equipment certification of Brazilian telecommunications equipment and implements it in accordance with the "Certification Regulations". Therefore, the industry calls this approval process ANATEL certification.
ANATEL needs to carry out the certification of telecommunications products through the designated certification body (OCD). All telecommunications products are divided into three categories, which are Class I equipment: telecommunications terminal equipment, Class II equipment: restricted radiation equipment, Class III equipment: other radio equipment, consumer electronics products are usually classified in Class I equipment or Class II equipment. Consumer electronics testing is usually performed at local laboratories in Brazil, as there are no authorized laboratories outside of Brazil. The production plant of Class I products needs to have the ISO9001 quality system certificate.
ANATEL certification must have the information of a local company in Brazil, which is called a "supplier" in the certification system.
According to ANATEL requirements, the "supplier" has technical, civil and criminal liability for its products, and it is not possible to transfer these responsibilities.
In terms of supervision, brand owners should pay attention to the requirements of Article 42 of Resolution No. 242 of 2000. Any entity shall not use products that have obtained ANATEL certificates to make leading publicity (such as using products that have obtained certificates to promote products that have not obtained certificates), otherwise they will be banned. Suspend or cancel the certificate; At the same time, we should also pay attention to Article 55. Manufacturers, distributors or users who use products that are not certified by ANATEL will face warnings, fines, detention and other punishments.
